Pune police to appeal against bail granted to the minor in Porsche hit-and-run case

Pune: The Pune police will approach the Supreme Court (SC) with an appeal to cancel bail granted to the child in conflict with law (CCL) in the hit-an-run case in Kalyani Nagar last month.

Two IT engineer friends, Anish Awadhiya (24) and Ashwini Koshta (24), were killed in the accident. The minor son of prominent city-based builder Vishal Agarwal was driving his father’s Porsche car in an inebriated condition in the wee hours at 160 kmph and hit the motorcycle of the victims. 

The incident sparked outrage after the Juvenile Justice Board (JJB) soon granted bail to the CCL, who was later sent to the observation home in Yerwada. He was recently freed after his aunt moved the Bombay High Court (HC) demanding justice for the minor.

Now, the Pune police have decided to challenge the HC decision in the SC. A news channel reported that the state government’s Home Department gave the go-ahead to the police to move the Apex Court over the issue. 

The Bombay HC admitted the petition filed by the CCL’s aunt and granted bail to him on June 25, directing to free him from the observation home. Now, the State government has permitted the Pune police to approach the SC to challenge the HC decision.

Earlier, the JJB, granting bail, had refused the Pune police request to put the CCL on trial. This decision invited a controversy. The JJB asked the CLL to write a 300-word essay on the accident and to prepare a placard to raise people’s awareness about traffic rules. The minor was also told to work with a traffic constable and seek counselling. This had enraged citizens across the city.

Later, the HC observed, during the hearing of the petition, that the CCL also went through a trauma and should be given time to realise his mistake. It said that an opportunity should be given to him to become a responsible citizen and that he could not be put in custody.
